GDPR Privacy Notice

The purpose of the General Data Protection Regulation ("GDPR") is to protect all European Union ("EU") citizens from privacy and data breaches by allowing citizens to maintain control of the personal data kept and processed by organizations, which includes Mediclever. The GDPR also protects the personal data of individuals, regardless of citizenry, in the EU.

Mediclever Ltd. ("Mediclever") is committed to safeguarding the privacy of personal data. This Privacy Notice outlines the collection, use, and disclosure of personal information provided to Mediclever by site visitors. When information is submitted to Mediclever, or you use Mediclever's websites and other services, you consent to the collection, use, and disclosure of that information as described in this Privacy Notice.

Mediclever Use of Information

Mediclever collects and processes personal data ("Information") from individuals only as necessary in the exercise of Mediclever's legitimate interests, functions and responsibilities as a privately owned, for-profit, company. For example, Mediclever also uses Information to conduct general demographic and statistical research to improve its marketing programs, to identify appropriate services or activities or comply with applicable laws. Finally, Information may be shared by Mediclever with third parties who have entered into contracts with Mediclever to perform functions on behalf of Mediclever, subject to the obligation of confidentiality and safeguarding from unauthorized disclosure.

Third Party Use of Sensitive Information

We may disclose your Sensitive Information and other Information as follows:

  • Consent: We may disclose Information if we have your consent to do so.
  • Emergency Circumstances: We may share your Information when necessary to protect your interests and you are physically or legally incapable of providing consent.
  • Employment Necessity: We may share your Information when necessary for administering employment or social security benefits in accordance with applicable law or any applicable collective bargaining agreement, subject to the imposition of appropriate safeguards to prevent further unauthorized disclosure.
  • Public Information: We may share your Information if you have manifestly made it public.
  • Archiving: We may share your Information for archival purposes in the public interest, and for historical research and statistical purposes.
  • Performance of a Contract: We may share your Information when necessary to administer a contract you have with Mediclever.
  • Legal Obligation: We may share your Information when the disclosure is required or permitted by international, federal, and state laws and regulations.
  • Service Providers: We use third parties who have entered into a contract with Mediclever to support the administration of our services and policies. In such cases, we share your Information with such third parties subject to the imposition of appropriate safeguards to prevent further unauthorized disclosure.
  • Affiliated Programs: We may share your Information with parties that are affiliated with Mediclever for the purpose of contacting you about goods, services, charitable giving or experiences that may be of interest to you.
  • De-Identified and Aggregate Information: We may use and disclose Information in de-identified or aggregate form without limitation.

Security

We implement appropriate technical and organizational security measures to protect your information when you transmit it to us and when we store it on our information technology systems.

Retention and Destruction of Your Information

Your information will be retained by Mediclever in accordance with applicable state and federal laws, and the applicable retention periods in Mediclever's Records Management policy. Your information will be destroyed upon your request unless applicable law requires destruction after the expiration of an applicable retention period. The manner of destruction shall be appropriate to preserve and ensure the confidentiality of your information given the level of sensitivity, value and criticality to Mediclever.

Your Rights

You have the right to request access to, a copy of, rectification, restriction in the use of, or erasure of your information in accordance with all applicable laws. The erasure of your information shall be subject to applicable state and federal laws, and the applicable retention periods in Mediclever's Records Management policy. If you have provided consent to the use of your information, you have the right to withdraw consent without affecting the lawfulness of Mediclever's use of the information prior to receipt of your request.

Information created in the European Union will be transferred out of the European Union to Mediclever. If you feel Mediclever has not complied with applicable foreign laws regulating such information, you have the right to file a complaint with the appropriate supervisory authority in the European Union.

Updates to this Policy

We may update or change this policy at any time. Your continued use of this site and third party applications after any such change indicates your acceptance of such changes.

Privacy Policy

Mediclever Ltd. ("Mediclever") provides this Web site ("site") as a service to the MedTech community and prospective clients. Use of the site is subject to the terms and conditions set forth below in Mediclever's Privacy Policy ("policy").

Although Mediclever respects the privacy of this site's users (or "members" or "visitors"), it collects information from its Web site members and visitors. The Privacy Policy governs users' interaction with the site and users' registration for and use of the site's online services. Except as set forth within this Privacy Policy, the site's Terms of Service agreement, and/or other published guidelines, Mediclever does not release personally identifiable information about the site's visitors without their permission.

Please note that Mediclever reviews these privacy practices from time to time, and that these practices are therefore subject to change. Mediclever asks users to periodically review this page to ensure continuing familiarity with the most current version of the site's Privacy Policy. The Information Mediclever Gathers

Mediclever gathers two types of information about the site's users:

  • Non-personally identifiable information
  • As users access the site, Mediclever collects and aggregates information indicating, among other things, which pages were visited, the order in which they were visited, and which hyperlinks were employed. Collecting such information involves the logging of IP addresses, operating system, and browser software used by each visitor. Although such information is not personally identifiable, Mediclever can determine from the IP address a visitor's Internet Service Provider and the geographic location of the user's point of connectivity.
  • The non-personally identifiable information collected helps in diagnosing any server problems, administering the site, identifying the most popular areas of the site, and determining the effectiveness of promotional activities.
  • For the same purposes, Mediclever uses "cookies" - that is, small text files placed on your computer's hard drive - to help determine the type of content and sites visited, the length of time spent on a particular site, and the usage of services offered via the site.   • Personally identifiable information
  • Certain areas of the site may require that users provide personally identifiable information (including, for example, zip code, age, income, and e-mail address). In addition, when registering to set up an account to use certain services on the site such as e-mail, chat rooms, forums, or to receive newsletters or specifically targeted information ("services"), Mediclever may require that users provide their name and e-mail address.
  • Mediclever does not knowingly collect personally identifiable information from children (defined herein as minors younger than thirteen years of age) without obtaining parental consent. Before registering for an account to use the services of the site, Mediclever requests that all minors have their parents read the Privacy Policy and continue their involvement throughout the registration process.
  • Mediclever does not control the acts of this site's members or visitors. All members and visitors should be aware that their disclosure of personally identifiable information in a bulletin board, chat room, guest book, or other forum allows other parties to send them unsolicited e-mail. In the event visitors encounter any user on this site who is improperly collecting or using information provided by the site's members or visitors, please contact info@mediclever.com.

How Mediclever Uses/Does Not Use Gathered Information

Please take some time to become familiar with the different ways Mediclever uses the information gathered. Keep in mind that, while Mediclever encourages all third parties involved to adhere to this site's Privacy Policy and to otherwise handle personal information in a responsible manner, Mediclever cannot and does not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information received either from Mediclever or independently. Nevertheless, in the event users encounter any third party associated with, or who claims association with Mediclever, who is improperly collecting or using personal information, please contact info@mediclever.com who will forward the message to the third party.

  • Use of non-personally identifiable information
  • Mediclever uses non-personally identifiable information in aggregate form to build higher quality, more useful online services by performing statistical analyses of the collective characteristics and behavior of the site visitors, and by measuring demographics and interests regarding specific areas of the site.
  • The site may contain links to other Internet Web site, including co/branded or other affiliated sites that may or may not be owned or operated by Mediclever. Unless otherwise explicitly stated, Mediclever is not responsible for the privacy practices or the content of such sites, including such sites' use of any information (such as IP number, browser type, or operating system) collected when visitors to the site click through links to those sites. Even though such information might not identify the user personally, users should be familiar with the privacy practices of those other sites.
  • Use of personally identifiable information
  • Mediclever provides notice to potential registrants of this site whose personally identifiable information will be collected during the registration process. Such notice is provided simultaneously with the user's registration on this site; moreover, this policy itself serves as notice that such information is collected under those circumstances. Although users may not "opt out" of the registration process and still receive access to the services, users may choose to "opt out" of receiving promotional materials from Mediclever and/or other business partners. If the user does not "opt out"of receiving such promotional materials, Mediclever reserves the right to release user's personally identifiable registration information to third parties who provide goods or services that Mediclever believes may be of interest to the user. If the user decides to discontinue receiving promotional information from such third parties, please contact those third parties directly, or contact Mediclever at info@mediclever.com.
  • Mediclever limits its own e-mail contact and solicitations to those users who have not "opted out" of receiving such communications. The solicitations are limited in that they, among other things, will clearly indicate the originator of the e-mail and provide the user with a method of "opting out" of receiving future communications of a similar nature.
  • Finally, Mediclever may use individual members' data to "pre-populate" forms, which are displayed for the purpose of collecting individual data by Mediclever. In no case does pre/populating a form transfer any data to any third party. Only if the user voluntarily requests that such data be transferred will any transfer take place - for example, if/when a user clicks a "submit form" button or other button.
  • Mediclever reserves the right to release any and all information contained within access logs concerning any visitor when that visitor is in violation of Mediclever's "Terms of Service" agreement or other published guidelines, or partakes (or is reasonably suspected of partaking) in any illegal activity, even without a subpoena, warrant, or other court order, and to release such information in response to discovery requests, or in response to any circumstance in which Mediclever, in its sole discretion, deems an emergency. Mediclever cooperates with law enforcement agencies in identifying those who may be using its servers or services for illegal activities. Mediclever also reserves the right to report any suspected illegal activity to law enforcement for investigation or prosecution.
  • Mediclever will post the relevant privacy information in the official rules and/or registration area for any promotions it sponsors. That privacy information, to the extent it conflicts with this Privacy Policy, will govern that particular promotion.

Security

All information gathered on the site is stored within a controlled database accessible only to Mediclever to protect the loss, misuse, or alteration of the information under its control. However, as effective as any security measure implemented by Mediclever may be, no security system is impenetrable. Mediclever cannot guarantee the security of its database, nor can it guarantee that the information supplied by users will not be intercepted while being transmitted over the Internet. Your Rights

If users would like to have personally identifiable information changed or removed from Mediclever's database, please contact info@mediclever.com. Keep in mind that there will be residual information remaining within the databases, access logs, and other records, which may or may not contain such personally identifiable information. The residual information will not be used for commercial purposes; however, Mediclever reserves the right, from time to time, to re-contact former customers or users of this site if lawful.

Information collected in the European Union will be transferred out of the European Union to Mediclever. If you believe that Mediclever has not complied with applicable foreign laws regulating such data or data transfers, you have the right to file a complaint with the appropriate authorities.

Mediclever Ltd. ("Mediclever") administers this Web site ("the site"). The terms and conditions set forth below ("the agreement") apply to all users accessing the site. Please read the following information carefully.

Because the Internet is an evolving medium, the terms of this agreement may change from time to time. Please periodically review and become familiar with these terms. Continued use of the site after the posting of changes to these terms will signify the user 's acceptance of these changes. Mediclever may immediately terminate any individual 's use of this site and/or such user's password(s) or account(s) in the event the user violates the terms of this agreement or engages in conduct that Mediclever, in its sole discretion, considers unacceptable. Code of Conduct

Users agree not to engage in any of the following conduct. Such conduct is unacceptable and may result in termination of use of the site.

Making Purchases

Users are free to license or purchase products or services described on the site. Merchants or applicable service providers may ask for certain information including but not limited to credit card or other payment information. Submissions

Where permitted, users may submit any text, images, data, or other materials ("content") to the site. In so doing, users acknowledge and agree that the grant of content to Mediclever is a royalty-free, perpetual, irrevocable, non-exclusive, worldwide right and license to link to, use, reproduce, transmit, modify, adapt, publish, display, perform, distribute, and translate content.

Further, by submitting content to the site, users certify ownership authority to grant such rights to Mediclever and acknowledge that the burden of determining whether any content posted or transmitted to the site by user is protected by copyright rests solely with user.

Privacy

Personal information that Web site users provide in connection with purchases, contests, polls, chat rooms, forms, forums, or other usages of the Web site or site-related services is collected by Mediclever. Any such information will be treated as described in Mediclever's Privacy Policy.

Use of Secure Area and Password

With Mediclever's grant of a password, users are given access to any password-protected area on the site. Users may not distribute the password to others unless first granted Mediclever's written authorization to do so. Users are responsible for all uses of their password.

Content Monitoring

Parental Control Provisions

Pursuant to 47 U.S.C. Section 230(d), as amended, Mediclever hereby notifies users that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist users in limiting access to material that is harmful to minors. Information identifying current providers of such protections is available at the Web site of the Electronic Frontier Foundation.

Void where Prohibited

Although the site is accessible worldwide, not all products or services discussed or referenced in or on the site are available to all persons or in all geographic locations or jurisdictions. Mediclever reserves the right to limit the availability of the site and/or the provision of any product or service to any person, geographic area or jurisdiction it so desires, in Mediclever's sole discretion, and to limit the quantities of any such product or service that it provides. Miscellaneous

This agreement is entered into in the state of Israel and shall be governed by and construed in accordance with the laws of the state of Israel, exclusive of its choice of law rules. Each party to this agreement hereby submits to the exclusive jurisdiction of the state of Israel, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce this agreement, the prevailing party will be entitled to costs and attorneys' fees. In the event that any of the provisions of this agreement shall be held by a court or other tribunal or competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect and enforceable.

This agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter herein, and any and all prior or contemporaneous written or oral agreements existing between the parties hereto are expressly canceled. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption, or paragraph title contained in this agreement is inserted only as a matter of convenience and in no way defines or explains any paragraph or provision herein.

Mediclever may at any time change the site, including eliminating or discontinuing any content or feature of the site, restricting its availability or limiting the amount of use permitted. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to, posting on the site, or by electronic mail, or by conventional mail. Use of the site after such notice shall be deemed to constitute user's acceptance of such changes, modifications, additions, or deletions.
